ORDER

This petition has been filed under Section 482 of Cr.P.C seeking quashment of FIR registered vide crime no.11/2015 under Section 365, 294, 506 (Part-A) of IPC read with Section 3(1)(x) of SC/ST (Prevention of Atrocities Act) and its consequential proceeding of trial in Case No.11/2022 pending before VIII Additional Sessions Judge/Special Judge (M.P) MLA District Gwalior(M.P). As per the case of the prosecution, the complainant made a complaint to the police that he is retired pensioner and working as Mahasachiv in the BSP party and Veerendra Kaushal and Ramkishan Baghel asked him before filling up the form of election that he should talk with the petitioner no.3 who was MLA at the relevant point of time. On 07/01/2015 along with his supporter respondent no.2 has filled the form and participated in the election. On 07/01/2015 at the time when complainant was at Canteen, petitioner no.3 along with petitioner no.2 and one Surendra Yadav came in white Car and took away the complainant and threatened not to contest the election. Thereafter, offence was registered against the petitioners.

Initially offence has been registered against the petitioners under Section under Section 365
