ORDER

This petition under Article 226 of Constitution of India has been filed seeking the following reliefs:

  • “7.1 It is therefore prayed that the Hon'ble Court may kindly be pleased to issue a direction in the nature of mandamus while directing to Tahsildar Mehadwani respondnent no.3 to decide the application u/s 32 of MPLRC vide ANNEXURE P-2 filed by the petitioner while recalling the order ANNEXURE P-3 and to pass fresh order after hearing the parties by following due process of MPLRC.

 

7.2 To grant any other relief as may be deemed fit and proper while looking to the facts and circumstances of the case.”

2. It is submitted by counsel for petitioners that an ex parte order of partition has been passed without issuing any notice to petitioners.

Petitioners have filed an application under Section 32 of M.P.L.R. Code for recall of order dated 16.06.2023 and for redetermination of application filed under Section 178 of M.P.L.R. Code. This application was filed on 12.02.2024 but according to petitioners said application is still pending before Naib Tehsildar, Mehadvani, District Dindori and no action has been taken.
