ORDER

This criminal revision under Section 397 r/w section 401 of Cr.P.C.

has been filed by the applicant/complainant aggrieved by the judgment dated 16.02.2006 passed in Cr.A.No.154/2005 by learned Additional Sessions Judge, Gadarwara District Narsingpur whereby allowing the appeal of the respondent No.2/accused, it modified the judgment of conviction and order of sentence passed by learned ACJM, Gadarwara in Criminal Case No.722/2003 (State of M.P. Vs. Nitin) and convicted him under section 324 of IPC with fine of Rs.1000/- instead of R.I.2 years under section 326 of IPC.

2. On 04.12.2023, this court had directed Principal District and Sessions Judge, Narsinghpur to appoint a competent Mediator to conduct the mediation proceedings to enable the parties to settle their dispute. The mediation report dated 18.01.2024 is received and as per report mediation has been successful.

3. Learned counsel for the respondent No.1/State and learned counsel for respondent No.2/accused have submitted that applicant/complainant Manish Chouksey and respondent No.2/accused Nitin Gupta had filed an application under Sections 320 and 320(2) of Cr.P.C. before the mediator and have submitted that they have
