JUDGEMENT

With the consent of both the parties, appeal is heard finally at motion stage.

This common order shall govern the disposal of Misc. Appeal No.1601 of 2018 (United Insurance Company Ltd. Vs. Prashant @ Golu & Ors.) and Misc. Appeal No.838 of 2018 (Prashant @ Golu Vs. Rajkumar & Ors.) arising out of impugned award dated 01.12.2017 passed by the Member MACT, Seoni Distt. Seoni M.P. in MACC No.100099/2015.

2. M.A.No.838/2018 has been filed by the appellant/claimant seeking enhancement, whereas M.A. No.1601/2018 has been filed by the appellant-insurance company for reduction of compensation award/exoneration of insurance company from the liability to pay the compensation.

3. In M.A. No.838/2018 learned counsel for the appellant has filed an I.A. No.7141/2020 under order 41 Rule 27 of C.P.C. for taking on record permanent disability certificate (PDC) as well as other medical documents. Learned counsel for the appellant submitted that impugned award has been passed on 01.12.2017 whereas, permanent disability certificate has been issued on 12.03.2020. As per permanent disability certificate appellant has suffered total blindness.

4. In view of above, this Court finds that
