ORDER
This is first application filed by the applicant under Section 439 of the Code of Criminal Procedure for grant of regular bail relating to FIR No.673/2023 registered at Police Station Chhola Mandir Bhopal District Bhopal (M.P.) for the offence under Sections 498-A and 306 of the IPC.
2. Learned counsel appearing for the applicant submitted that applicant and prosecutrix were not having good relationship in the marriage. She was depressed and committed suicide. Applicant has not abetted the offence of suicide. There is no positive act or any over act which drove the deceased to commit suicide.
3. Learned Government Advocate appearing for the State opposed the application for grant of bail and relied upon the suicide note left by deceased wherein she has stated that she is committing suicide as applicant is having relationship with his sister-in-law and applicant does not love the deceased.
Once applicant also told her to go and die. In these circumstances offence is made out.
