ORDER

This is the repeat (second) application filed by the applicant under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail in connection with FIR / Crime No.132/2020 registered at Police Station - Kharakuan, District - Ujjain for commission of offences punishable under Sections 328, 304/34, 120-B, 201 of the Indian Penal Code, Section 49-A of the M.P. Excise Act & Section 6(1)(a) of the Poisons Act. The applicant is in custody since 19.10.2020.

02. As per prosecution story, one Shaikh Farooq demanded spirit for preparation of sanitizer from Jitendra Mukati, a proprietor of Deepmala Chemical who gave him a sample of spirit. Thereafter, Shaikh Farooq requested him to provide 100 litre of spirit for which Jitendra Mukati contacted Rupesh Sharma working in Imperial Chemical Industry for purchase of spirit. Rupesh Sharma instructed him to collect 100 litre of spirit from another employee namely Ram Lakhan working as Guard. Thereafter, Jitendra Mukati collected two canes of 50 - 50 litre of Isopropyl Alcohol (IPA) and further sold to Shaikh Farooq for Rs.6,500/-.
