ORDER

The petitioner has preferred this petition under Article 226 of the Constitution of India for issuance an appropriate writ, order or direction thereby directing the respondents No.2 and 3 to take an appropriate action against the respondent No.4, who has illegally snatched a Proclain Machine HX-360 owned by the petitioner. On 31.8.2023 when the said Proclain Machine was crossing the petrol pump of the respondent No.4, then the respondent No.4 stopped the truck loaded with this machine and with the help of some anti-social element took away the said machine to his petrol pump and unloaded the same at the premises of the petrol pump. There is some dispute regarding the outstanding amount of diesel with one Darshan Dwarikadas Rathi, who is a contractor and was using the machine of the petitioner. The petitioner approached the respondent No.3 i.e. Station House Officer for lodging a complaint in respect of the commission of cognizable offence, but the same was not registered.
