ORDER

1. They are heard. Perused the case-diary.

2. This is the third TEMPORARY bail application filed by the applicant under Section 439 of Criminal Procedure Code, 1973, as he/she is implicated in connection with Crime No.358/2022 registered at Police Station AZAD NAGAR INDORE (MP) for offences punishable under Sections 302/34, of Indian Penal Code, 1860 and under section 25, 27 of the Arms Act for grant of temporary bail on account of marriage of his two daughters Shivani and Bhumika, which is to take place on 10.5.2024. His earlier bail applications have (SUBODH ABHYANKAR) JUDGE already been dismissed by this Court.

3. Counsel for the applicant has submitted that the applicant is in jail since 25.05.2022 and is seeking temporary bail on the ground of marriage of his two daughters Shivani and Bhumika as he is required to arrange for the marriage of his daughters.

4. The factum of marriage of applicant's daughters Shivani and Bhumika on 10.5.2024 has already been verified by the counsel for the State as directed by this Court.

5. Counsel for the respondent/State has not opposed the prayer.

6. On due consideration of submission and on perusal of the case-diary, this Court finds force with the contentions as advanced by counsel for the applicant and considering the fact that the daughters of the applicant are to get married on 10.5.2024, he is lodged in jail since 25.5.2022, without commenting on merits of the case, the application for temporary bail is allowed. It is directed that applicant shall be released on temporary bail for a period of three weeks only from the date of his release, subject to his furnishing a personal bond in the sum of Rs.50,000/- (Rupees fifty thousand) with one solvent surety of the like amount to the satisfaction of the concerned trial Court. That applicant shall surrender before the Trial Court immediately on or before the expiry of aforesaid period, failing which, the Police Authority will be at liberty to arrest the applicant without further reference to this Court.
