ORDER
This is first application filed by applicant under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail relating to Crime No.248/2023, registered at Police Station-Madan Mahal District Jabalpur (MP) for the offences under Sections 420, 120 of IPC.
2. Learned counsel appearing for the applicants submitted that they are purchasers of property and have not committed any cheating. Property is said (VISHAL DHAGAT) JUDGE to have sold to them by Vimla Marwaha, first wife of Shri B.C.Verma. There is civil dispute between Vimla Marwaha and Seema Marwaha over property in question. Applicants are falsely implicated in the case. In these circumstances, applicants may be released on anticipatory bail.
3. Learned Government Advocate appearing for the State opposed the anticipatory bail application. False deed was made by applicants and cheating has been committed.
4. Heard learned counsel for the parties. 5. Offence is punishable upto seven years of imprisonment. Applicants are real estate developers and there is no likelihood that they will abscond from law. There is also civil dispute between successors of B.C.Verma.
