ORDER

The present Revision is filed under Section 397 of Cr.P.C r/w Section 401 of Cr.P.C being aggrieved by the order dated 2/3/2024 passed in Criminal Revision No.2/2023 whereby the Revision filed by the applicants has been dismissed.

2. The applicants filed a complaint against the respondent Nos.2-6 alleging that the respondents/accused persons entered into their house and made sexual assault on two minor daughters and also on the adult female members present in the house. On the basis of said allegation, a complaint was filed for taking the cognizance for offences under Section 294, 323, 506, 452, 352, 354 of IPC and POCSO Act. Initially a police report was made in crime No.482/2022 but the police has registered only offences under Section 452, 294 and 506(II) of IPC and did not register the offences under Section 354 and POCSO Act. In the said case, charge-sheet has been filed and the same is pending as Criminal Case No.985/2022 before the Court of Judicial Magistrate First Class, Bagli. By the impugned order the complaint was dismissed affirming the order refusing to take cognizance for offence under Section 354 of IPC and POCSO Act.
