ORDER

This criminal appeal has been filed under Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the order dated 03.02.2024 passed by the Special Judge, Narmadapuram; whereby, the application of the appellant under Section 439 of Cr.P.C. seeking bail has been rejected.

2. Appellant has been arrested on 22.09.2021 in connection with Crime (VISHAL MISHRA) JUDGE No.548/2021 registered at Police Station - Seonimalwa, District-Narmadapuram (M.P.) for the offence punishable under Sections 460, 380, 302, 307, 34 and 201 of IPC and Sections 3(2)(v) of the SC/ST (Prevention of Atrocities) Act.

3. It is submitted that the appellant has falsely been implicated in the case and he has not committed any offence in any manner. FIR has been lodged against unknown person and the present appellant is implicated only on the basis of the memorandum of the co-accused. Co-accused Rahul has already been enlarged on bail by this court vide order dated 03.11.2023 and the case of the present appellant is similar to that of co-accused.
