ORDER

This is the first application filed by the applicant under Section 438 of Cr.P.C for grant of anticipatory bail relating to FIR No.23/2024, dated 17.1.2024, registered at Police Station Tendukheda District Narsinghpur (MP) for commission of offence under Sections 8, 20(B), 29 of NDPS Act.

Applicant apprehending his arrest in the aforesaid offence has knocked the portal of this Court for grant of anticipatory bail.

2. As per the prosecution story, on 17.1.2024 01 kg and 150 gms contraband ganja was seized from the possession of co-accused Moolchand.

In his memorandum, he informed that the aforesaid contraband was given to him by Abhishek Rajak and he as per the instructions of Abhishek was going to sell it.

3. Learned counsel for the applicant has submitted that applicant is innocent. He has not committed any offence. He has been falsely implicated. No contraband was seized from his possession. He has been arraigned as accused only on the basis of memorandum of co-accused. Therefore, placing reliance on the order dated 8.2.2023 passed in Cr.R. No.2324/2022, it is prayed that applicant may be released on anticipatory bail.
