Since these petitions have been preferred against the same order passed by the appellate Court and involve same questions of facts and law, they have been heard together and are being decided by a common order.

These petitions under Article 227 of the Constitution of India have been preferred by defendant No.1 and defendant No.2 being aggrieved by order dated 21.11.2023 passed in MCA No.26/2023 by the 4th Additional District Judge, Dhar, District Dhar reversing the order dated 06.10.2023 passed in Civil Suit No.151-A/23 by the Civil Judge, Junior Division, District Dhar and allowing the application under Order 39 Rule 1 & 2 of the CPC preferred by the plaintiff/respondent No.1. 3. As per the plaintiff, he is the adopted son of Ram Ratanlal. By order dated 30.04.1994 passed by the revenue authority, Ratanlal was recorded over the suit lands in the revenue records upon holding him to be the owner thereof. Ever since then Ratanlal was recorded over the suit lands and was in possession of the same. By a Will dated 30.06.2012 Ratanlal bequeathed the entire suit lands in his favour and he has become the owner thereof upon his death. By order dated 29.05.2014 passed by the revenu
