This is the first bail application filed on behalf of the applicant/accused under Section 438 of the Cr.P.C. for grant of anticipatory bail, as he is under apprehension of his arrest, in connection with Crime No.37/2024, registered at Police Station Hanumana, District Mauganj (M.P.) for the offences punishable under Sections 409, 420 and and 120-B of Indian Penal Code
2. Learned Senior Counsel appearing for the applicant submitted that an irregularity has been committed by the applicant acting as a Chief Executive Officer of Janpad Panchayat, Hanumana. It is submitted that firm/company to whom cheque has been issued by applicant does not have TIN number and registration of company has expired but goods/services were supplied for which payments were made. No cheating or criminal breach of trust has been committed by the applicant. Act of applicant may be negligent but does not have any mens rea. In these circumstances, applicant may be enlarged on anticipatory bail.
