ORDER

01. The petitioners have filed the present petition seeking the following relief/s :

“7(i) To issue a writ, order or direction in the nature of mandamus appointing Petitioner No.1, namely Mrs. Indu Prajapati W/o. Shri Yashwant Chakravarti, as the guardian of her husband - Shri Yashwant Chakravarti who is in comatose state to protect his interest, administer bank accounts, investments, land interests, etc. and in the event of necessity to sell the immovable property standing in the name of her husband and to use the proceeds towards medical treatment of her husband and family welfare expenses;

Petitioner No.1 is wife and petitioners No.2 and 3 are the daughters of Yashwant Chakravarti. They all are permanent residents of Indore. Petitioner No.1 has taken voluntary retirement from her services of Punjab National Bank. Petitioner No.2 is the eldest daughter and at present, she is unemployed and eligible for marriage.

Petitioner No.3 is a student aspirant for higher studies. Yashwant Chakravarti is also a Government employee in the services of Rural Engineering Services. He was suffering from Mouth Cancer and had been on medical leave since 12.8.2022. According to the petitioners, a
