ORDER

This is the first application filed on behalf of applicant under Section 438 of Cr.P.C. for grant of anticipatory bail relating to Crime No.39/2024 registered by Police Station - Kotwali, District - Shahdol (M.P.) for commission of offence under Sections 420 of IPC.

2. Learned counsel for the applicant has submitted that applicant is innocent and has been falsely implicated in the crime in question. It is submitted by learned counsel for the applicant that offence under Section 420 of IPC is not made out against the applicant. Case is of civil nature. Nothing is (PRAMOD KUMAR AGRAWAL) JUDGE to be recovered from him. Agreement is dated 06.03.2020 while the complaint has been lodged on 18.10.2023 i.e after three years. Applicant is entitled to be released on anticipatory bail in the light of Judgement delivered by the Supreme Court in the case of Arnesh Kumar vs. State of Bihar 2014 (8) SCC 273. 3 .
