ORDER
Petitioner's grievance is that he was given appointment on the post of Constable in the Police Department and was given posting at Mandsaur. As per Column No.12 of the Verification Form, it was found that the petitioner had disclosed a fact of termination of Criminal Case pertaining to Crime No.31/2020 for the offence under Sections 294, 323, 506, 34 of the Indian Penal Code, 1860 on the basis of the compromise.
It is submitted by learned counsel for the petitioner that since the matter has come to an end on the basis of the compromise, therefore, the respondent No.4 Superintendent of Police, District Mandsaur was not justified in issuing the order dated 7.3.2023 (Annexure P/1) holding him to be ineligible for Police Services. He also submits that the respondents have not taken into consideration the law laid down by the Apex Court in State of Madhya Pradesh & Others versus Parvez Khan (2015) 2 SCC 591 and, therefore, this writ petition be disposed of directing the respondents to consider & decide the petitioner's representation in the light of the law laid down by the Apex Court in State of Madhya Pradesh & Others versus Parvez Khan (supra).
