This is first application filed by the applicant under Section 438 of the Cr.P.C . for grant of anticipatory bail relating to Crime No. 97 of 2024 registered at Police Station Kotwali, District - Sheopur (M.P.) for the offence under Sections 420, 406 of IPC.
Learned counsel for the applicant/accused argued that applicant is innocent and has been falsely implicated. Main allegations are against co-accused Anoop @ Annu Singhal and Deepchand. FIR is not against present applicant/accused. As per prosecution story, Anoop Singhal sold the grains to applicant/accused. He has been arrayed only on account of memorandum of co-accused Anoop. The FIR is registered on account of some dispute in business transaction. However, the matter has already been settled between complainant and co-accused Anoop and Deepchand which is evident from the documents annexed along with I.A. No. 13728/2024 as well as from the order dated 10.05.2024 passed by this Court in M.Cr.C. No.16269/2024.
