These applications coming on for admission this day, the court passed
the following:
ORDER
This order shall govern the disposal of M.Cr.C. Nos. 22040 of 2024 and 22039 of 2024.
2. These are first bail applications filed by applicants namely Rajkumari Singh Gond and Ku. Sukhmanti Singh Gond respectively under Section 439 of the Code of Criminal Procedure for grant of regular bail relating to FIR/Crime No. 41/2024 dated 21.2.2024 registered at Police Station Langhadol, District Singrauli for the offences punishable under Sections 304-B, 498-A, 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
3. The counsel for the applicants submits that the applicants are innocent and have been falsely implicated in the case. The applicants are mother-in-law and sister-in-law of the deceased. It is submitted that the applicants are suffering from various ailments and are undergoing treatment. It is submitted that the applicants are in custody since 4.4.2024 and trial would take considerable time to conclude, therefore, the applicant be released on bail.

The counsel for the State has opposed the application and submitted that there are specific allegations against the applicants regarding committing cruelty upon the deceased in connection with the demand of dowry. Therefore, looking to the gravity of offence, the applicants are not entitled to be released on bail.
5. Heard the submissions advanced on behalf of the parties and perused the case.
6. As per the case of the prosecution, applicant Rajkumari Singh Gond is the mother-in-law and applicant Ku. Sukhmanti is the sister-in-law of the deceased, who committed suicide by hanging herself within a year from the marriage. There are specific allegations against the mother-in-law, sister-in-law and husband that they used to commit cruelty upon the deceased for bringing a motorcycle from her maternal house. It has also come on record that on the date of incident also, the husband of the deceased beat her due to which she committed suicide. Therefore, looking to the fact that there are specific allegations against the applicants regarding demand of dowry and committing cruelty and also the fact that deceased committed suicide within one year from her marriage, this Court is not inclined to release the applicants on bail.
