ORDER
I.A.No.11363 of 2024, an application under Section 301(2) of CrPC for assisting the prosecution is taken up, considered and allowed for the reasons mentioned therein.
Shri Ankur Maheshwari - Advocate and his associates are permitted to assist the prosecution on behalf of the complainant.
The applicant has filed this first bail application under Section 439 of Cr.P.C . for grant of bail. Applicant has been arrested on 21.03.2024, by Police Station Ganjbasoda, District Vidisha (M.P.) in connection with Crime No.496 of 2023 for the offence punishable under Sections 406, 409 of the Indian Penal Code.
2. It is the submission of learned counsel for applicant that the applicant is suffering confinement since 21.03.2024 on false pretext and the charge-sheet is likely to be filed soon. Looking to the nature of allegation which was primarily documentary in nature, chance of tampering with the evidence/witnesses is remote.
3. Learned counsel for the applicant fairly submits that he stands by the commitment that he has to pay the dues to the complainant as reflected in the memo and soon he shall pay the amount to the complainant.
