This first bail application of applicant-Karan Verma and second bail application of applicant-Shiwanshu Verman under Section 439 of the Code of Criminal Procedure have been filed for grant of regular bail in relation to FIR No.403/2022 dated 15.07.2022 registered at Police Station Nagod, District Satna (M.P.) for commission of offence under Sections 376(2)(i), 376(2)(l) of IPC, Sections 4(2), 5/6 of POCSO Act, 2012. Applicants are in detention since 05.07.2023.

2. Applicant-Shiwanshu's first bail application was dismissed as withdrawn and not pressed vide order dated 19.12.2023 passed in M.Cr.C. No.50134/2023.

3. As per the prosecution story, on 14.07.2022, Child Welfare Committee, Satna submitted an application before police alleging that on 07.07.2022, 13 year old minor has been violated by someone. In the course of investigation, prosecutrix was found only 13 year and 6 months old. She was a beggar. Her maternal grandmother stated that prosecutrix mental condition is not sound. She was found to be carrying two months pregnancy. It was apparent that someone had violated her. F.I.R. was registered. After taking sample of fetus and blood samples of accused persons, as per t
