ORDER
The petitioner has filed the present petition challenging the order dated 24.02.2024 whereby the application filed by defendant under Order VII Rule 11 of Civil Procedure Code, 1908 has been allowed and the plaintiff has been directed to value the suit and pay the court fees under the provisions of Section 7(x) of Court Fees Act, 1870 (hereinafter referred as “Act of 1870”).
02. The plaintiff entered into a contract to purchase truck bearing registration No.RJ-17-GA-6665 from defendant No.1. The defendant No.1 got financed the aforesaid truck from the defendant No.2 and got it registered with defendant No.3. According to the plaintiff, an agreement to sale was executed on 15.06.2022 and the same was notarized. By way of agreement, defendant No.1 agreed to sale the said truck in Rs.17,03,000/- and out of which Rs.9,06,000/- was paid by way of cash. The plaintiff agreed to pay the remaining amount to the finance company by way of 10 equal installments.
