ORDER

This is third application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail relating to FIR No.87/2023 dated 20.03.2023 registered at Police Station-Gunga, District-Bhopal (M.P.) for commission of offence under Sections 302, 294, 34 of IPC. Applicant is in detention since 28.07.2023.

2 . Applicant's first and second bail applications were dismissed as withdrawn and not pressed vide order dated 03.07.2023 passed in M.Cr.C.No.18738 of 2023 and order dated 16.02.2024 passed in M.Cr.C.No.864 of 2024.

3. As per the prosecution story, o n 20.03.2023, complainant Jitendra Sahu lodged FIR that on 19.03.2023 at around 08:30 pm, he heard the noise of commotion. When he reached on the spot, he found that Abhishek Nath, Sharad Narh, Ramyatri Nath & Omvati Nath with an intention to kill Shiv Prasad were assaulting him by means of wood-sticks. They also abused him. Later, Omnath armed with wood-stick also reached there and assaulted him by means of wood-stick and had threatened to do death. Complainant rescued Shiv Prasad and brought him to his home. He had sustained injuries in his feet, back, head and hands. Incident was witnessed by Mahendra Singh, M
