This is first application filed under Section 439 of Cr.P.C. by the applicant – Nafees Hussain S/o. Sher Khan, who has been arrested by Police on 23.2.2021 in connection with Crime No.60/2021 registered at Police Station Pipliyamandi, District Mandsaur for the offence punishable under Section 4, 6/9 of M.P. Govansh Pratishedh Adhiniyam; Section 6-A, 6-B(1), 10 & 11 of M.P. Krishak Pashu Parirakshan Adhiniyam; Section 11(D) of Prevention of Cruelty to Animals Act; and Section 49(A) of the M.P. Excise Act. As per prosecution story, on 20.2.2021, the police seen a Bolero pick-up vehicle bearing Registration No. MP-43-G-3729 coming from Pipliamandi, but did not stop despite signal given by the police. The vehicle was chased by the police, but the driver and one another fled away after leaving the vehicle in the forest earea. The police searched the vehicle in which four litres of spirit was found and 7 bulls were recovered.
Since the bulls were kept in cruel and unhygine manner, therefore, offence under the provisions of Govansh Pratishedh Adhiniyam, Krishak Pashu Parirakshan Adhiniyam along with the provisions of Excise Act have been registered. On the basis of Registration No.
