This first application has been filed by applicant under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of bail in connection with Crime No.321/2024 registered at Police Station Gwalior, District Gwalior (M.P.) for offence punishable under Sections 354(A), 354(D) of IPC and Section 11(iv)/12 of POCSO Act. Applicant is in judicial custody since 15.07.2024.

As per the case of prosecution, victim aged around 17 years, submitted a typed complaint on 29.05.2024 to SHO, PS- Gwalior that on 29.02.2024, Harimohan @ Honey (applicant) met her near Kila Gate, around 5:00 in the evening, when she was going to coaching. Honey caught hold of her right hand and proposed to marry her. She escaped and came to home. She informed her parents about the incident. Honey used to harass her since both of them were studying in Saraswati Shishu Mandir, Badalgarh. Feeling aggrieved by harassment of Honey, she tried to commit suicide by setting herself ablaze at home. She was admitted at Birla Hospital. After discharge from hospital, she reported the matter.
