ORDER

1. Heard. 2. This petition under Section 482 of the Cr.P.C has been preferred by the petitioner / accused for quashment of FIR No.0075/2020, registered at police station Sitamau, District Mandsaur for offence punishable under Section 34(2) of the M.P. Excise Act, 1915 and all subsequent proceedings pursuant thereto.

3 . As per the prosecution, on 17/2/2022 a secret information was received at the police station to the effect that one Maangu Singh shall be transporting liquor illegally. On the said information the police party reached the informed spot which was Kasba Sitamau Laduna Chourah and stopped a super splendor motorcycle without number plate and discovered ten boxes of country made liquor which were being transported by co-accused Maangu Singh.

Though he tried to escape but was arrested. The liquor was found to be illicit liquor and being transported without a valid licence. Thereafter the memorandum of co-accused Maangu Singh was recorded under Section 27 of the Evidence Act in which he stated to have procured the said liquor from the present petitioner on the basis of which he has been implicated for the present offence.
