ORDER

1. This petition under Article 226 of the Constitution of India has been filed against order dated 17.04.2008 passed by respondent no. 3 in exercise of suo-moto power of revision.

2. It is the case of the petitioner that a departmental inquiry was conducted against the petitioner on the charges that :-

(i) from 11.10.2005 he is on an unauthorized absence and remained outside his headquarter and he sent an application along with prescription slip issued by the Hospital, Maihar and District Hospital, Satna through some other person, as a result, he tried to mislead the department which is indicative of grievous in discipline.

(ii) The petitioner was arrested in crime no.326/05 registered at Police Station Lalganj, District Pratapgarh (UP) for offenses under Sections 147, 148, 149, 302, 307, 323, 504, 506 of IPC and Section 7 of C.L. Act, as a result, he tarnished the image of police in the eyes of public.

(iii) Abovementioned behavior is violative of Para 64 (2) of Police Regulations.

3. A departmental inquiry was conducted and ultimately by order dated 25.8.2007 issued by Superintendent of Police, Satna, he was awarded punishment of reduction of his salary to the minimum pay
