ORDER

This first bail application has been filed by the applicant under Section 438 of Code of Criminal Procedure , 1973 for grant of anticipatory bail to the applicant, who is apprehending his arrest in connection with Crime No.259/2023, registered at Police Station Purani Chawani, District Gwalior (M.P.) for offence punishable under Sections 147, 148, 294, 323, 506 of IPC and added Section 326 of IPC.

As per the case of prosecution, Hargovind Kirar reported to SHO Police Station Purani Chawani, District Gwalior that on 14.06.2023 around 06:00 in the evening, his uncle Mukesh, Jagdish and his father Suresh were digging plinth of the house. Ajeet Kirar armed with Gainti, Murari armed with lathi, Ramjilal armed with danda, Ajay Kirar armed with danda came there. Rahul (applicant), Ramkishan and Monika also arrived there. All the accused abused them in filthy language. Oral altercation ensued between the parties with regard to digging of plinth. Ajeet Kirar assaulted Mukesh with Gainti on his head.
