Per Anil Verma, J. :
The petitioner has filed present petition under section 482 of Cr.P.C being aggrieved by the order dated 21/10/2021 passed by the Special Jduge, CBI, Indore in Special case no. 01/2009, whereby learned Court below has dismissed the application filed for providing certificate of CD and cassettes, so that the same can be sent for voice recognition report.
2. In the Court below, the petitioner/accused filed an application for providing certified copy of the CD and cassettes, which as per the prosecution incorporated conversation and voice recordings respectively, so that it can be sent to voice expert. After hearing both the parties, learned Court below rejected the application filed by the petitioner, therefore, the said order is under challenge before this Court.
3. Learned counsel for the petitioner submits that the impugned order passed by learned Court below is contrary to law and facts on record. Learned Court has erred in not appreciating the fact that the petitioner is not causing any delay in the trial, but only demanding fair trial.
