ORDER

The present petition is filed under Article 227 of the Constitution of India challenging the order dated 3/9/2024 passed by Ist Civil Judge, Junior Division, Ujjain in RCS A 500108/2014 whereby the application filed by the respondents/plaintiff Nos.1,2 & 5 under Section 17(1)(A)& (b) of the Registration Act, 1908 (hereinafter be referred as the Act, 1908)has been allowed and it has been held that the document in question is inadmissible in evidence being unregistered document.

The facts of the case succintly are that the defendants Nos. 1 to 3 have 1 MP-5302-2024 NEUTRAL CITATION NO. 2025:MPHC-IND:2963 filed their written statement of defense and prayed for dismissal of the suit. The petitioners (plaintiffs) have preferred a civil suit(Annexure P/4) seeking declaration of title, partition and permanent injunction against the defendants with respect to the agricultural lands bearing Survey Nos. 100, 102/1, 103,104, 105/1, 106, 107/1 and 109/3 having total area admeasuring about 11.965 hectare, situated at Village Tajpura Tehsil Mahidpur, District Ujjain.
