This petition has been filed by the petitioners under Article 226 of the Constitution of India , seeking the following reliefs :-

(A) Petition may kindly be allowed by issuing appropriate writ order or direction by directing/commanding the respondent department to grant the benefit of annual increment from 01.07.2009 and thereafter fresh order of revised pensionary benefit may be passed alongwith consequential benefits there from including arrears with interest @ 10% per annum.

(B) Any other relief which this Hon'ble Court deems fit in the facts and circumstances of the case may be awarded along with the cost of present petition.

2. Counsel for the petitioner submits that the case of the petitioner is squarely covered by the order passed by the Division Bench of this Court at Gwalior in the case of Yogendra Singh Bhadauria and Ors. Vs. State of Madhya Pradesh and Ors. W.A. No.645/2020 dated 22.09.2020, which reads as under:-

"The instant writ appeal has been filed under Section 2(A) of M.P. Uchcha Nyayalay (Khand Peeth Ko Appeal) Adhiniyam, 2005 assailing the final order dated 06.03.2020 passed in WP 25702/2019 by learned Single Judge while exercising writ jurisdiction under Art
