ORDER

This first application has been filed by applicant under section 439 of Code of Criminal Procedure, 1973 for grant of bail in connection with Crime No.137 of 2024 registered at Police Station Maharajpura, District Gwalior (M.P.) for offence punishable under Section 392 of IPC and Section 11/13 of the MPDVPK Act. Applicant is in judicial custody since 29-02-2024. As per the prosecution case, Nikita reported to SHO of Police Station Maharajpura, District Gwalior that on 22.02.2024, she was going towards Mahaveer Nagar along with her family members. Two boys came on motorcycle. One of them snatched her mangalsutra. Thereafter, both the boys fled away on motorcycle. On such allegations, Police Station Maharajpura registered FIR at Crime No.137 of 2024 for offence punishable under Section 392 of IPC and Section 11/13 of the MPDVPK Act. Applicant was arrested on 29-02-2024. He is in custody ever since. One mangalsutra was recovered at the instance of accused Ankush. The complainant did not identify the applicant in Test Identification Parade. Statements of witnesses have been recorded. Relevant seizures have been made. Investigation is underway.
