1. By way of instant petition under Article 227 of the Constitution of India the the petitioner is seeking following reliefs:-

The facts giving rise to the present writ petition are that against the award passed in claim case No.25/93x06 present petitioner had preferred an M.A. No.306/2000 for enhancement of compensation before this Court. The Division Bench of this Court in Miscellaneous Appeal No. 306/2000 (Atar Singh Vs. Ramprakash etc.) had increased the compensation amount of Rs.3,79,200/- granted to the petitioner from the Motor Accident Claims Tribunal and interest at the rate of 6% per annum from 04.05.1993 to the date of payment i.e. 04.04.2006 was also accepted on the said amount, which came to Rs.2,95,776/- for 13 years. Thus the total amount awarded was Rs.6,74,976/- which the respondent had to deposit in the Motor Accident Claims Tribunal but the respondent deducted Rs.29,896/- as TDS from the interest amount of Rs.2,95,776/- and deposited it in the Court. Being aggrieved with the aforesaid, the petitioner made a prayer for releasing the said amount but the Motor Accident Claims Tribunal by the impugned order had rejected the same.
