Heard and perused the record.
This order shall govern the disposal of these three miscellaneous criminal cases as they have arisen out of the same crime number of the same police station, hence, they are heard analogously and are being decided by this common order.
2. These are the bail applications filed by the applicants under Section 439 of Criminal Procedure Code, 1973, for grant of bail during trial. The applicants are facing trial in connection with Crime No.383/2023, registered at Police Station Mandleshwar, District Khargone, for the offence under Sections 399, 402 of IPC, 1860 & Section 25, 27 of Arms Act. The applicants are in custody since 22.12.2023.
3. Allegations against the applicants are that they were hatching conspiracy to commit dacoity.
4 . Learned counsel for the applicants submits that the applicants are innocent and have been falsely implicated in the present crime. One country made pistol has been recovered from the possession of the applicant Kanti, one car from has been recovered from applicant Dhawal and one iron tomy has been recovered from applicant Anil.
