1. This second appeal has been preferred by the appellant under Section 100 of the Code of Civil Procedure, 1908 (in short "CPC") against the impugned judgment and decree dated 7.2.2023 passed by the 5th Addl. District Judge, Ujjain in Regular Civil Appeal No.21-A/2022, thereby affirming the judgment and decree dated 11.3.2022 passed by the 2nd Civil Judge, Senior Division, Ujjain in Civil Suit No.32-A/2020, whereby the trial Court has dismissed the plaintiff's suit seeking relief of declaration of title, permanent injunction and partition.
2. The facts of the case, in brief, are that the appellant/plaintiff was married with respondent's father Lalchand on 25.1.2006 at Ujjain by Gandharv Vidhi as per Hindu rituals and rites. She was legally married wife of the deceased Lalchand. Lalchand died on 22.1.2011. Lalchand had owned a house No.65/1 D, Gopalpura, Maxi Road, Ujjain. After the death of Lalchand, the appellant is entitled for 50% share in the disputed house. On the aforesaid ground, she has preferred a civil suit for declaration of title, permanent injunction, partition and possession before the trial Court.
