ORDER

1. This application under Section 482 of Cr.P.C . has been filed seeking the following reliefs :-

  • “That this Hon’ble Court may kindly be pleased to issue and directing respondent nos.3 to 4 to decides & passed the speaking order in the petitioner Complaint (Ann.P/1) in according to law which may decide within time bound period in the light of identical order passed in the case of MCRC 40055/23 As per (Ann P/3) in according to law.”

2. It is mentioned in the application that in spite of multiple complaints made by the applicant, FIR has not been lodged by the police.

3. Per contra, the application is vehemently opposed by counsel for the State. It is submitted that the applicant has an efficacious remedy of approaching the concerning Magistrate under section 190 and 200 Cr.P.C . 4. Heard the learned counsel for the parties.

5. The moot question for consideration is as to whether an application for a direction to the Police to lodge an FIR is maintainable or not ? 6. The Supreme Court in the case of Aleque Padamsee and others vs. Union of India & Ors, reported in (2007) 6 SCC 171 has held as under :-
