Also heard on I.A. No. 11217/2016 an application

for suspension of sentence and for grant of bail.

The facts of the case reveal that the applicant has

been convicted by the judgment of conviction dated

20-09-2011 for an offence u/s 409 of IPC passed by the

learned Judicial Magistrate Class-1 Manawar, District Dhar

in respect of Crime No. 36/2005. He has been sentenced

to undergo three years rigorous imprisonment alongwith a

fine amount of Rs.2000/-. The judgment of conviction has

been affirmed by the appellate court by order dated

21-12-2016 passed in Case No. 310/2011.

Mr Vivek Sharan, learned counsel for the applicant

has argued before this court that the applicant was a

Manager of the Samiti and he has made a scape goat

alleging

that

he

has

not

deposited

a

sum

of

Rs. 1,31,
