ORDER

Case diary is perused.

Learned counsel for the rival parties are heard.

The applicant has filed this first application under Section 439 Cr.P.C for grant of bail.

Applicant has been arrested on 10.04.2023 by Police Station City Kotwali District Bhind (M.P.) in connection with Crime No.122/2023 registered for offence under Sections 34(2) of the M.P. Excise Act.

The case of the prosecution in nutshell is that on 10.04.2023 after receiving information that a car bearing No.UP16AX8883 is coming to Bhind from Qwari river with illicit liquor, the police force went to the spot and stopped the car. On searching the car, the police force recovered 151.92 liters of liquor from the possession of two person. On the basis of the aforesaid, crime has been registered.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case. He is in custody since 10.04.2023. Offence is triable by JMFC. Applicant has no criminal antecedent. Disposal of the matter will take long time. The applicant is permanent resident of District Gwalior and there is no likelihood of his absconsion or tampering with the prosecution evidence. He is ready to abide by the terms and condit
