ORDER
This is the second bail application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail relating to Crime No.910/2023 registered at Police Station - Kotwali, District Sidhi (M.P.) for commission of offence punishable under Section 8, 21, 22, 27A, 29 of the NDPS Act, 1985 and 5/13 of M.P. Drugs Control Act. Applicant is in detention since 12.09.2023. His earlier bail application was dismissed as withdrawn on 06.03.204 in M.Cr.C. No.50944/2023.
2. As per the prosecution story, police authority received information from an informant and reached on the spot. During search, police has found total 6600 Alprazolam table and 5040 of Tramadol Hydrocloride capsules from the possession of applicant. On the basis of aforesaid, Police registered the case against the applicant under the aforesaid Sections.
3 . Learned counsel for the applicant has submitted that applicant is in custody since 12.09.2023 and he has not committed any offence. He is innocent. He has been falsely implicated.
