ORDER
This is the second application filed by the applicant under Section 439 of Cr.P.C. for grant of regular bail relating to Crime No.35/2024 registered at Police Station Dhanpuri, District Shahdol (M.P.) for the offence under Sections 8(b), 21 and 22 of NDPS Act and Section 5/13 of M.P. Drug Control Act 1949. He is in custody since 07.02.2024.
2. His earlier bail application was dismissed as withdrawn by order dated 08.04.2024 passed in M.Cr.C. No.9993/2024.
3 . A s per the prosecution story, 16 bottles of codeine containing wincerex cough syrup were seized from the possession of applicant. Each bottle contains 100 ml cough syrup. Thereafter, Police registered the case against the applicant under the aforesaid sections.
4. Learned counsel for the applicant has submitted that applicant has not committed any offence. He is innocent. He has been falsely implicated. It is submitted that applicant is first offender. Charge-sheet has been filed. There is no criminal antecedents of applicant. In the aforesaid pretext, he has prayed that applicants be released on bail.
