ORDER

Heard with the aid of case diary.

This is repeat second bail application filed under Section 439 of Cr.P.C. for grant of bail to the applicant/accused, relating to FIR/Crime No.609/2022 dated- 01.06.2022 registered at Police Station- Manawar, District- Dhar (M.P.) for commission of offence punishable under Sections 363, 366-A , 376 , 376(2)(n) , 376(2)(k) and 343 of IPC and under Sections 3/4 and 5L/6 of the Protection of Children from Sexual Offences Act .

2. First bail application of the applicant was dismissed on merits vide order dated 31.10.2023 passed in M.Cr.C. No.28090/2023.

3. Prosecution story, in brief, is that at the time of the incident, the prosecutrix was aged around 16 years. Around 7 days prior to the incident, the applicant had called father of prosecutrix. The prosecutrix picked up the call and informed that her father is not available at home. Thereafter, the applicant repeatedly for 2-3 days called on the phone number of father of prosecutrix and talked to her. On 31.05.2022, at 05:00 PM, when the prosecutrix went to market, the applicant met her and told that he loves and wants to marry her.
