ORDER

Pleadings are complete. With the consent of learned counsel for the parties, the petition is finally heard.

2. By the instant petition filed under Article 226 of the Constitution of India, the petitioner is challenging the order dated 16.05.2023 (Annexure-P/7) passed by the Commissioner, Sagar Division, Sagar, whereby the appeal preferred by the petitioner against the order dated 04.11.2022 passed by the Additional Collector, has been rejected.

3. The facts of the case in a nutshell are that the petitioner and respondent Nos.5 and 6, all have submitted their applications in pursuance to the advertisement issued for appointment of Aanganwadi Sahayika of Gram Panchayat Khejramaphi, Tehsil Jaisinagar, District Sagar. Along with these persons, other candidates have also applied and total 14 applications were received. Thereafter, appointment was made in favour of the petitioner vide order dated 26.07.2022. The petitioner joined the services in pursuance to her appointment order on the same day i.e. 26.07.2022. However, the appointment of the petitioner has been assailed by respondent No.5 before the Additional Collector Sagar, who in turn, vide order dated 04.11.2022 not
