This petition under Section 482 of the Cr.P.C. has been preferred by the petitioners against the order dated 19.01.2019 passed by 1st Additional Session Judge, Ganjbasoda, District Vidisha in Criminal Revision No.17/2018, whereby order dated 24.10.2016 passed by the Judicial Magistrate First Class, District Vidisha taking cognizance against the petitioners for offence punishable under Section 494 of the IPC on private complaint filed at the instance of respondent, was confirmed.

2. This case, vide order dated 19.07.2023 passed by Coordinate Bench, was directed to be listed alongwith First Appeal No.1338/2018. Therefore, both the matters were analogously heard. However; looking to the different nature of litigation and nature of reliefs claimed, separate orders have been passed.

3.Necessary facts for adjudication are that respondent/Sandeep Raghuwanshi filed a private complaint against the petitioners for the offence punishable under Section 494 of the IPC on certain allegations that complainant, as per the Hindu rites and rituals, solemnized marriage with petitioner No.1-Smt.
