ORDER
Apprehension of arrest has given rise to filing of this first application on behalf of the applicant under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail, in connection with Crime No.51/2022 registered at Police Station Mahila Thana, District Narsinghpur (M.P.) for the offence punishable under Section 376, 376(2)(N), 328, 506 of IPC.
Learned counsel for the applicant sanguinely submits that the incrimination of the applicant in the alleged crime is nothing but a fallacy inasmuch as false allegation of developing physical relation by the applicant with prosecutrix that too without her consent, has been made. Focusing on FIR (Annexure-A/10), learned counsel for the applicant submits it is basically a case of consent. Justifying the innocence of applicant, he submits that the incident had occurred on 30.11.2017 and the complainant herself has admitted that she allowed the applicant to stay in her house and even after committing rape, the complainant got appointed the applicant in her school where she is Principal.
