This petition coming on for orders this day, th e court passed the

following:

ORDER

The present petition is filed under Article 226 of the Constitution of India being aggrieved by the order dated 03.05.2024 passed by Commissioner/Registrar, Cooperative Societies, Bhopal, whereby he has formed a committed of three members comprising Joint Commissioner, Cooperative Societies, Ujjain Division Ujjain, Deputy Commissioner, Cooperative Societies, Indore and Shri R.K Patil, Assistant Commissioner. The petitioner submits that the petitioner is one of the allottee of plot by the said society. The petitioner apprehends that the said committee may submit adverse report against him. It is further submitted that earlier committee was constituted by Collector by order dated 01.08.2023. Learned counsel for the respondent/state submits that no cause of action has arisen so far. There is no bar to constitute a fresh committee by Commissioner/Registrar, Cooperative Society to make an inquiry into the allotment of plots, eligibility etc. The petition is pre-mature. After hearing learned counsel for the parties, learned counsel for petitioner has failed to point out any provision of law that there is a bar for constitution of second committee to make an inquiry into the affairs of the cooperative society. The petition is based on apprehension that the said committee may submit adverse report against the petitioner.

In view of the aforesaid, this Court does not find any merit in the petition.

The petition is dismissed as being premature.
