This petition under Article 227 of Constitution of India has been filed against the order dated 27.1.2024 passed by Principal Judge, Family Court, Chhatarpur in Case No.121-A/2022 by which the application filed by the respondent under section 24 of Hindu Marriage Act has been allowed and the petitioner has been directed to pay interim maintenance @ Rs.10,000/- per month, apart from expenses @ Rs.350/- on per appearance as well as Rs.2000/- as a lump sum litigation expenses.
2. It is submitted by counsel for petitioner that the petitioner had filed an application under section 9 of Hindus Marriage Act for restitution of conjugal rights, which was allowed ex parte and an application filed by the respondent under Order 9 Rule 13 CPC has also been dismissed on the ground of delay. It is further submitted that the petitioner has no source of income as his Mill has already closed down during the Corona period. In fact the respondent is not willing to reside with the petitioner in spite of the decree for restitution of conjugal rights and the petitioner is not in a position to pay the interim maintenance.
