ORDER

1.This petition under Article 226 of Constitution of India has been filed seeking the following relief:-

2. It is submitted by counsel for petitioner that an FIR in Crime No.61/2025 has been registered at Police Station Pohari, District Shivpuri for offence under Sections 376 of IPC and 3/4 of Dowry Prohibition Act .

3. It is the case of the petitioner that his son has been falsely implicated on account of political rivalry and accordingly, it is prayed that the police may conduct free and fair investigation and must exonerate the son of the petitioner.

4. Heard the learned counsel for the parties.

5. The first question for consideration is as to whether the petitioner can file a petition for exoneration of his son or not and whether an accused can seek a direction from this Court for the investigating agency to investigate the matter in a particular manner or not?

6. The Supreme Court in the case of Romila Thapar and others vs. Union of India and others reported in (2018) 10 SCC 753 has held as under:-
