ORDER

This application under Section 482 of Cr.P.C . has been filed for quashment of FIR in Crime No.136/2023 registered at Police Station Khitola Bazar, Sihora, District Jabalpur for offence punishable under Sections 294, 323, 327 and 506 of IPC.

2. It is submitted by counsel for applicant that according to prosecution case, applicant demanded Rs.500/- for purchasing liquor, which was refused by the complainant and on that issue not only the applicant abused the complainant filthily but also assaulted him by picking up a bucket, which was lying in the shop and also extended a threat to his life.

3. Challenging the FIR lodged by the complainant, it is submitted by counsel for applicant that in fact on 15.03.2023, applicant and other persons had made a complaint against illegal construction being made in Bus-Stand, Khitola Ward No.12. Similar complaint was also made to SHO, Police Station Khitola Bazar, Sihora District Jabalpur 20.03.2023. Although no action was taken by any of the authority but the complainant was aggrieved by the continuous action of applicant against so called encroachment, which was being done by the complainant and other witnesses, therefore, he has been roped
