ORDER

This petition under Article 227 of Constitution of India has been filed seeking the following reliefs:-

"i. The Petitioner prays for appropriate direction to the learned XXVII Additional District Judge Jabalpur to decide Petitioner's application for attachment of Respondent's account without further delay.

ii. Any other relief which the Hon'ble High Court considers just and reasonable be granted in circumstances of the case."

2. It is submitted by counsel for petitioner that the petitioner has filed an application for attachment of judgement debtor's account for realization of decretal amount, however, the said application is not being decided. Accordingly, it is prayed that the Executing Court may be directed to take up the application, as early as possible.

3. Considered the submissions made by counsel for petitioner.

4. If any application has been filed, then it has to be decided on priority basis.

5. Accordingly, the 27th Additional District Judge, Jabalpur is directed to decide the pending interlocutory application within a period of one month from today.

6. The other party must file its reply to the pending interlocutory application (if not already filed) within a period of 15 days from today but the pending application must be decided latest by 08.02.2024

7. With aforesaid observation, the petition is finally disposed of

8. Office is directed to sent a copy of this order to the Executing Court for necessary information and compliance.
