ORDER

The present petition is filed under Section 528 of BNSS, 2023 seeking quashment of the impugned order dated 3/10/2024 passed by Judicial Magistrate, First Class, Indore whereby the application filed by the petitioner seeking permission for renewal of passport has been rejected on the ground that the passport is valid upto 9/5/2025 and, therefore, the application for permission to renewal of passport is premature.

Counsel for the petitioner submits that the applicant had earlier filed M.Cr.C No.4290/2024 challenging the order dated 14/6/2022 whereby his application for permission for issuance of passport was rejected. The said petition was allowed and disposed off in following terms:-
